Pocket Later – Terms of Use

These Terms of Use ("Terms") govern your use of the Pocket Later mobile application (the "App"), provided by Avi Tsadok ("we", "us", or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Agreement between you and us, not Apple

These Terms are between you and Avi Tsadok only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works of the App, except as permitted by law.

3. Your content and acceptable use

You are responsible for any content you save, create, or store in the App. You agree not to use the App to:

You keep ownership of your content. You give us only the permissions needed to operate the App and provide its features to you.

4. Privacy

Your use of the App is also governed by our Privacy Policy: Pocket Later Privacy Policy.

5. Maintenance and support

We are solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to provide maintenance or support services for the App. For support, contact us at avitsadok@me.com.

6. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the App will be uninterrupted, error-free, or that your content will never be lost; please keep backups of anything important.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.

7. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed USD $50.

8. Product claims

We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

9. Intellectual property

The App, including its design, code, and branding, is owned by us or our licensors. In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.

10. Legal compliance

You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Third-party terms

You must comply with any applicable third-party terms (for example, your wireless data service agreement) when using the App.

12. Third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

13. Termination

You may stop using the App at any time by deleting it. We may suspend or end your access if you violate these Terms. Sections that by their nature should survive termination will survive.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continuing to use the App after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules, except where the law of your place of residence requires otherwise.
